By subscribing to The Hub you  and your team will have access a growing set of resources all in one place. as public sector services providers transition to the new regulatory regime. As public sector buyers transition to the new regulatory regime no more searching for documents, information, help and guidance, you will have access to: 
  • Primary and Secondary legislation relating to the Procurement Act 2023 as it is published with explanations of the new requirements;
  • Secondary Legislation such as Statutory Instruments which are entered into law but with parliamentary approval only, the full legislative process of an Act is not required;
  • PPNs and other government guidance setting out the rules which guide the buyers - know what they are required to do by law;
  • Checklists, bite sized courses and other information to help you understand the new regulations and to tender successfully in the future;
  • Articles giving detailed descriptions of aspects of the new requirements relevant to the services, health and social care sectors with suggestions for action.

The Problems

If you are a provider of health, social care, housing or services and you rely on tendering for public sector contracts the Act will affect you and your business. The problems associated with understanding the changes are very real.  The scale of the changes facing the sector raises the problem of knowing where to find a reliable "go to" source of information, documentation and guidance, updated where necessary. The Hub will provide this information ensuring you can future proof your tendering success and stay ahead of the competition. 


The 2023 Act represents a significant change in tendering for services, including health and social care involving, not just those preparing tenders but those in governance, management and service delivery. Public service contracting is about to will change once again. An additional change which became law on 29th November 2023 Regulates how NHS procurement will be undertaken from 1st January 2024.


The 2023 Act:

  • applies to all tenders, except for some defined exemptions and NHS procurement.
  • requires social care tenders to comply with all the rules. There are some areas of exemption for tenders defined as Light Touch Contracts (LTCs). 
  • ensures buyers comply with the rules for all tendering processes, methodologies, award procedures, etc., except where exemptions exist.
  • includes a much expanded list of reasons for tenderers, contractors and sub-contractors, to be excluded from public sector contracting.
  • separate Regulations apply to NHS procurement by means of secondary legislation which comes into force on 1st January 2024.
The Procurement Act became law on 16th October 2023 and will come into force in October 2024. During the twelve months secondary legislation will be put in place along with other guidance for implementing the Act
